TERMS AND CONDITIONS,
Welcome to Airborne Boards!
Before proceeding, it’s crucial to review and understand the terms and conditions below. By continuing to use our website, placing an order, or using our boards, you acknowledge that you have read, understood, and agreed to abide by these terms.
Safety Precautions:
• Prioritize safety! Always wear a helmet and appropriate safety gear while riding your board.
• Be aware that the board may lose brakes or power due to low battery on the skateboard or remote. Ride cautiously within your comfort zone in such instances.
• Respect local road regulations and avoid busy roads with markings. Comply with and know your area's riding rules.
• Exercise extreme caution with trigger sensitivity in the highest speed modes. Gradually familiarize yourself with gentle trigger control during acceleration and braking.
• Riding under the influence of drugs or alcohol is strictly prohibited.
• Avoid wet conditions as riding in such conditions might lead to the board slipping and causing injury.
• Show utmost respect for pedestrians at all times.
• Ensure to protect your carbon fiber wings (axle) from hitting walls, hard surfaces, or pebbles. While carbon fiber is strong and lightweight, it can be brittle.
Maintenance and Usage:
• Board maintenance is your responsibility. Regularly check and tighten all screws and nuts on the skateboard. Keep your bearings clean for optimal performance and a smoother ride. Dirty bearings may affect ride quality, reduce battery efficiency, and potentially cause bearing failure.
Warning:
• Water exposure poses a severe risk to the board’s electronic and mechanical components. Riding in wet conditions can result in damage not covered by warranty.
• Avoid subjecting the board to abuse. Jumping, riding off gutters or curbs, harsh impacts, or dropping the board can lead to damage not covered by warranty.
Safety Reminder on Riding Hills:
• Riding on steep hills can be hazardous. Always be cautious when riding uphill, especially when preparing to descend. Understand how to manage speed without relying on electric brakes in case of brake failure or malfunction.
I. Standard Business Terms
§ 1 Basic Provisions
(1) These business terms apply to all agreements made between us as the supplier (Airborne Boards) through our website. Unless specifically agreed upon, any additional conditions from your end are disregarded.
(2) A ‘consumer’ referred to here is any individual whose transactions aren’t primarily tied to their commercial or independent professional activities. A ‘businessman’ includes any natural or legal person or legally responsible partnership making a transaction related to their independent professional or commercial activity.
§ 2 Conclusion of the Contract
(1) The contract concerns the sale of products.
(2) Our website's offers are non-binding and do not establish a binding contract offer.
(3) Using our online shopping cart system constitutes a binding purchase offer. Items in the ‘Shopping cart’ can be modified before finalizing the order. Once personal data, payment, and shipping details are entered on the ‘check-out’ page and the purchase is confirmed using the “purchase” button, you have made a binding offer.
(4) The contract is accepted and concluded through a confirmation (e.g., email). Failure to receive confirmation within a specified period results in the restoration of any services provided without delay.
(5) You are not bound by requests for offers; we provide a textual and binding offer via email, valid for 5 days.
(6) Order execution and contractual details are communicated via email, partially automated. It is your responsibility to ensure your email address is accurate and doesn’t block our emails.
§ 3 Right of Retention, Reservation of Proprietary Rights
(1) The right of retention applies to claims arising from the same contract.
(2) Goods remain our property until the purchase price is fully paid. If you’re a businessman:
a) Ownership remains with us until all claims from the ongoing business relationship are settled.
b) Goods can be resold within an orderly transaction. You assign claims from the resale to us equal to the invoiced amount, and we accept this assignment.
c) In cases of combining or amalgamating goods, co-ownership is acquired proportionally.
d) We release securities when their realizable value exceeds the secured claim by more than 10%. We determine the securities to be released.
